At Daré Bioscience, Inc. (“Daré,” “we,” “us” or “our”) we take your privacy and the security of your information very seriously.

This Privacy Policy (“Policy”) covers Daré owned and operated websites, including https://darebioscience.com and https://daretoplaybio.com and all of their sub-domains (each, a “Site” and collectively, the “Sites”), and any related services, applications and social media pages offered via the Sites (collectively, the “Services”).  This Privacy Policy is incorporated into, and is part of, our Terms of Service available at https://darebioscience.com/terms-of-service which govern your access to the Sites and your use of the Sites and/or Services.  Unless otherwise defined herein, capitalized terms shall have the meaning assigned to such terms in the Terms of Service.

The Policy describes the types of information we gather from people visiting our Sites and from individual users (“you” or “users”) interacting with our Sites and how we use, transfer, and secure such information.  By accessing any Sites or using any Services, you agree to be bound by this Policy.  This Policy does not govern information we receive from third parties.  If you do not agree to the terms of this Policy, please do not use the Sites, or any of our Services.  Each time you use any Sites, or any Services, the current version of this Policy will apply. Accordingly, when you use any Sites or Services, you should check the date of this Policy (which appears at the top) and review any changes since you last reviewed the Policy.

1. TYPES OF INFORMATION WE COLLECT 

We may collect two types of information from users of our Sites and Services:  “Personal Information,” which is information that you provide that can be used to identify you (such as name, email address, etc.), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Sites, browser type, etc.)

1.1. Personal Information Collected 

1.1.1 We collect Personal Information that you voluntarily provide to us when you use our Sites and Services.  For example, you may provide us with your email address, first name and last name, a message (which could, at your discretion, contain Personal Information), or other Personal Information when contacting us or signing up for our distribution list.

1.1.2. We collect information when you communicate with us. The specific types of information we collect will depend on the forum in which you communicate with us. For example, if you send us an email, we will collect your email address and the content of your email.

1.1.3. We do not control your use of our Sites and Services to share Personal Information with others.  If you choose to share information publicly through our Sites or Services, if such sharing is made possible, please understand that we cannot control the actions of third parties who could collect this information.

1.1.4. Some links on our Sites may redirect you to third party websites and services that Daré does not operate.  The privacy practices of these websites and services will be governed by their own policies.  We make no representation or warranty as to the privacy policies of any third parties, including the providers of third party applications.  If you are using third party websites, you should review and understand that party’s applicable policies, including their privacy policy, before providing your information to the third party.

1.2. Aggregate Information Collected

1.2.1. Aggregate Information is information that does not identify you.  Aggregate Information may be collected when you visit our Sites or interact with our Services, independent of any information you voluntarily enter.  We may collect, use, store, and transfer Aggregate Information without restriction.

1.2.2. Information may also be collected about your device when you use our Sites. This information may include: 

– Hardware types, system version, Internet Protocol (IP) address, device ID, and device language.

– Your country and general location, time zone, and language used.

– The specific actions that you take when you use our Sites, including but not limited to the pages and screens that you view or visit, search terms that you enter, and how you interact with our Sites. 

– The time, frequency, connection type, and duration of your use of our Sites.

– Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message.

– Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below).

– Pages you visited before or after navigating to our Sites. 

– Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

2. COOKIES AND ANALYTICS

2.1. Use of “Cookies”

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Sites, to analyze our web traffic using analytics, to test content, and to store information about your preferences.  A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us, and you have choices with respect to cookies.  By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies.  If you choose to reject all cookies it may affect your ability to use aspects of our Sites.  You can learn more about cookies and how they work at www.allaboutcookies.org.  You can always disable cookies through your browser settings. 2.2. Analytics

2.2.1. We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our Sites. 2.2.2. We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Sites or social media and whether or not certain content, such as a video was viewed. We may work with a trusted third party to collect and process this information for us, based on our instructions and in compliance with this Policy.

3. HOW WE USE YOUR INFORMATION

Daré’s use of your information (including any Personal Information) is subject to applicable laws regarding information use, disclosure, and retention. In general, however, we use information to operate the Sites, run Daré’s business, partner with third parties, communicate with you, and provide products, services, and information that you request from us.  This may include but is not necessarily limited to the following: 

– Providing, operating, improving, maintaining, and protecting our Sites, including the safety and security thereof.

– Sharing information with affiliates and third party service providers in accordance with the terms of this Policy.

– Sending you updates, marketing communications, and other information about Daré and our products, promotions, and our Sites. 

– Targeted advertising on third party platforms and websites, and we may share your Personal Information with third-party service providers for the purposes of targeted advertising as defined by some data privacy laws.

– Enhancing or improving your user experience.

– Providing you with technical and other support.

– Sending you notices and alerts.

– Conducting research, analytics, and monitoring and analyzing trends and usage for our Sites.

– Contacting you and responding to your inquiries.

– As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request.

– Enforcing contracts, including investigation of potential violations thereof.

– Detecting, preventing, or otherwise addressing fraud, security, or technical issues.

– Protecting against harm to the rights, property, or safety of Daré, our customers, or the public as required or permitted by law.

4. SHARING OF PERSONAL INFORMATION WITH THIRD PARTIES

4.1. We do not rent or sell your Personal Information.  

4.2. We may transfer Personal Information to third parties for the purpose of operating our Sites, providing the Services, and as necessary to comply with laws and legal process.  We may disclose Personal Information to our affiliates or third party service providers to provide you with the Services.  For example, we may transfer your Personal Information to third party service providers to provide (i) the functionality of the Sites and (ii) communicate with you. These third party service providers are not authorized to retain, share, store or use the Personal Information for any purposes other than to provide the services they have been hired to provide.

4.3. We may also elect to transfer your Personal Information to third parties under special circumstances: (i) to comply with a legal requirement, judicial proceeding, court order, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Daré; (iv) when we believe it is necessary to protect the rights, property, or safety of Daré or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Daré.

4.4. We may also share Personal Information with companies, agencies, organizations, or individuals outside of Daré at your direction or when we have your consent to do so. 

5. MARKETING & SOCIAL MEDIA

5.1. When you provide your email address to Daré we will send you updates, marketing communications, and other information about Daré, our Services, and our products, promotions, and our Sites.  Our marketing communications include an unsubscribe option for your convenience if you no longer wish to receive these messages from us. 

5.2. If you interact with us on social media, we may collect your social media profile information, your communications with us, and your posts on our social media pages.

6. CORRECTIONS/INFORMATION REMOVAL/OPT-OUT

6.1. You can request that any Personal Information stored by Daré to be deleted at any time by contacting us at [email protected].  We may require you to provide certain information to verify that it is you making the request.

6.2. If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the unsubscribe instructions included in each communication.

7. CHILDREN AND PRIVACY

7.1.1. We do not knowingly collect Personal Information from children in connection with the features of our Sites or Services. If we become aware that an individual under the age of 13 has provided personally identifiable information through our Sites or Services, we will immediately remove the individual’s personally identifiable information from our files.

8. HOW DOES DARÉ PROTECT MY INFORMATION

8.1. We take the security of your Personal Information very seriously.  We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third-parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

8.2. Any email or other communication purporting to be from Daré or one of our websites asking you to provide sensitive information should be treated as unauthorized and suspicious and should be reported to us immediately by emailing us at [email protected].

9. INTERNATIONAL VISITORS

9.1. We operate the Sites, Services and our business from the United States. If you use our Sites or Services from other regions of the world with laws governing data collection and use that may differ from the laws of the United States, then please note that by sending an email or other communication containing Personal Information or by providing Personal Information to us through our Sites, you are assuming the risk of doing so and are voluntarily transferring your Personal Information outside of those regions to the United States and other countries.  

10. CHANGES TO THIS PRIVACY POLICY

10.1. Each time you use our Sites or Services the current version of the Policy will apply. When you use our Sites, you should check the date of this Policy (which appears at the top of the Policy) and review any changes since the last version. Our business changes frequently and this Policy is subject to change from time to time. Unless stated otherwise, our current Policy applies to all information that we have about you. We will not materially change our policies and practices to make them less protective of your privacy without the consent of affected customers.
